Terms and Conditions

This is an agreement between "Shipshape Services Ltd" hereafter referred to as the business and those purchasing services and or products from the business known as the customer.


Valet Services

Valet service is defined as any form washing or detailed cleaning / polishing to a specific area requested by the customer. This involves the business using valet personnel, machines and cleaning products, plus what ever else is necessary to produce the desired result. Although every effort is made to remove all markings, stains and other stubborn marks, the business cannot guarantee all such marks can be removed. The business makes every effort to valet each specific area requested to the highest standard, however fair wear and tear plus age of the vessel must be considered.

Due to the nature of the environment and often customers not on site at the completion of the business service, the business cannot be held responsible for soiling and or de-generation of the vessel after job completion. Effects such as dirty rain, general dirt from neighbouring vessels, other people boarding the vessel / other factors, ie exhaust and other airborne dirt is not the responsibility of the business with it's effects to the vessel in question.


Management services

A boat management and gaurdinage service is offered by the business. This is tailor made to the requirements of the customer. The business is only responsible to carry out the tasks stated in the "Management Agreement". This agreement details what services the customer wishes. If the business discover that the vessel is in imminent danger, for what ever reason, the business have authority by the customer to carry out whatever is felt reasonable to ensure the safety of the vessel and or it's occupants. It is understood both by the business and customer that all responsible and practical measures are always taken to ensure the safety of staff, customers and associated equipment.


Shipshape Members Club

To qualify as a member, the customer is required to agree a fortnightly, four weekly or six weekly valet programme.

In addition to the advertised "Members Club Benefits", current members will be entitled to discounted rates on all other services through the business. Discount is calculated on the frequency of services within the membership scheme, remaining valid only during the membership period. Membership privileges are not interchangeable from vessel to vessel. The business honours the discount scheme during the agreed membership period, however is able to alter or change at any stage with no prior warning new memberships or those being re-validated. A full exterior valet may be required prior to becoming a member.

The member's vessel must be inspected prior to agreement of any fees. Membership has a minimum of 6 wash sessions and requires a deposit of 60% of the member's total fee. The balance of payment will be invoiced at the end of the 3rd month and is subject to the standard terms as set out in this agreement.


Provisioning Service

This is the supply to customers by the business or approved sub-contractor of goods sourced from retail outlets.

Provisioning service in conjunction with other services incurs a charge of £15. If no other work is being carried out then a standard charge of £35 is made.

If the provisioning service is part of a larger package of services carried out by the business within the same visit to the vessel, payment terms are as per normal company policy of 14days. If only provisioning is being supplied we are pleased to accept cash or cheque no later than upon delivery of goods unless a valid member, whom will be invoiced with their appropriate discount on the service, not goods.

Cancellation 48 hours before delivery will incur the full cost of goods and a service charge of £15

Returns - Any substitutions are made in good faith and we regret that no returns are accepted. All provisioning supplies will be in date and good condition at point of delivery. The Business cannot be held responsible for subsequent deterioration or damage. The Business will always endeavour to deliver at the time agreed with the Customer. Occasionally this may not be possible due to circumstances beyond our control. We will in these circumstances try to keep you fully informed of any delay / rescheduling.


Dinner and Drinks Entertainment

A deposit of not less than 15% of total cost will be required upon booking. We ask that the balance be paid no less than seven days prior to event. Cancellation within seven days of event will incur a charge of 30%. Regretfully cancellations made within 72 hours of the event will incur a full charge.


Own Boat Tuition

Subject to availability, a competent RYA qualified skipper with a commercial endorsement is available for hints and tips for both Sail and Power. The own boat tuition scheme is designed to allow you to become more confident in the general safe handling of your vessel. It will allow you to get the best from your vessel but is not a formal qualification. It is the customer's responsibility to ensure the vessel is insured and adequately kitted out for sea. If at the skippers discretion the vessel is unsuitable for use s/he will make this known and the tuition will be cancelled. In this instant no refund will be available, however the business will work with the owner to resolve the problem and try to re-schedule a new date.

Regretfully cancellations made within 48 hours of the event will incur a full charge.


Delivery Service

All delivery vessels are subject to inspection and approval by the business. Failure of this approval determines that the business is unable to offer this service and is revoked of any responsibility.

All vessels moved must be on their own insurance.  It is suggested that owners check with their insurance any restrictions relating to boat movements by other people.

It is the customer's responsibility to satisfy themselves with all insurance details and practices. If s/he enters into a contract directly with the delivery skipper or crew, the business cannot in this circumstance be held responsible in any form.

Pricing

All boats will be required to have an initial inspection carried out prior to any confirmation of pricing. Any indicated pricing prior to inspection is only provided as a rough guide. Therefore the business cannot be held to a certain price if after inspection it discovers work involved reflects a differing higher or lower price structure. Shipshape Services is VAT registered. All prices quoted are exclusive of VAT.

Once the business has inspected the vessel and submitted a written report to the customer, this pricing structure and proposal for work to be carried out will be valid for a period of 28 days, subject to vessel conditions and location not changing to effect the work proposed.

There is a minimum charge of £35 for any service carried out by the business

For the satisfaction of local Marina legislation, to abide by the BMF (British Marine Federation) recommended terms & conditions, to satisfy our insurers and the business's own in-house policy, the customer hereby agrees that consenting the business to carry out work in either the form of a service or product, they have read and understood the business terms & conditions and are giving permission to allow employee's of the business access to their vessel to allow the work to be carried out.


Payment

We are pleased to accept cheque, cash or debit/credit card payments.

Upon the completion of specified work the business will invoice the customer and require payment within 7 days or longer if agreed. Failure of the customer to pay within this period will result in further action being taken.  Payment due dates are printed to each invoice.

If it is evident that payment has still not been received after further request then the business will employ legal representation to recover owed monies.  In these regretable circumstances all aditional costs associated with the collection of the money will be paid by the customer.

We will exercise our statutory right to claim interest (at 5% per month over the Bank of England base rate) and compensation for debt recovery costs under the late payment legislation if we are not paid according to our agreed credit terms.

These terms are subject to English Law and any dispute arising under them shall be submitted to the jurisdiction of the Courts of England and Wales.
